These booking conditions set out our contract and terms of business and your contract will be governed and read in accordance with English Law and will be subject to the exclusive jurisdiction of England & Wales.
Bookings are accepted by telephone and in writing but we insist that you complete a booking form. This will help us to ensure we have the correct booking information and your precise requirements.
DEPOSIT AND PAYMENT
Before making a booking you must have read and accepted these terms.
We prefer you to make a provisional telephone booking first. Once your deposit or full payment is received we will forward a written confirmation/account. A non-refundable deposit per person will be required as follows:
- Guided holidays £200, Worldwide holidays £200, Norway £100,
- All other European destinations £40.
Some special holidays may require a larger deposit. A refundable breakage/cleaning deposit may also be required by certain suppliers.
Balances are generally due 10 weeks prior to departure, the full holiday balance will normally be requested for bookings within this period. You should understand that we start to incur costs once a booking has been made.
Failure to pay your balance within the due date could result in the cancellation of your holiday.
NOTE Insurance Premium must be paid at time of booking.
IMPORTANT NOTE
Airlines will often make charges for name changes or incorrect name spellings, it is critically important that you ensure we have the correct name spelling, it is best to put this on the booking form to eliminate any potential errors.
Names must be as per passport.
VEHICLE HEIGHT – SAIL-DRIVE
Height restrictions apply to certain decks and different ferry companies. You must inform us at the time of booking, of the height of any vehicle if over 1.7 metres.
CANCELLATION BY YOU
You, or any member of your party, may cancel your holiday at any time providing that the cancellation is made by the person signing the booking form and is communicated to us in writing. As this incurs administrative costs, we will retain your deposit and in addition may apply cancellation charges up to the maximum shown below. Charges shown as a percentage of holiday cost.
Period before departure
- More than 42 days: deposit only
- 29-42 days: 30%
- 15-28 days: 45%
- 8-14 days: 60%
- 7 days to date of departure: up to 100%
Cancellation charge insurance: If you take out Martins World Group travel insurance at the time of booking, and have to cancel your holiday for a valid reason, you will be able to reclaim cancellation charges. Please check your policy document for full details.
Our suppliers may charge additional fees. Sail drive with self-catering will always affect the cost to the remaining passengers, often the equivalent of a zero refund.
PRICE GUARANTEE
Once we have confirmed your holiday in writing we guarantee the price against currency fluctuations. Any changes, such as increased airport or security fees or taxation imposed by Government, may be passed on with due notice. Any increases in fuel costs passed on to us by our suppliers due to Government action resulting in war may also be passed on to you.
OUR COMMITMENT TO YOU
It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance.
Occasionally changes may be made and we reserve the right to do so at any time. Most of these changes are minor and we will advise you or your travel agent of these at the earliest possible date. Flight timings and carriers used in the brochure are subject to change due to airline procedures. These details are given for guidance only and final details will be shown on your tickets.
If a major change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure. Changes to aircraft type or airline are deemed to be minor changes. When a major change occurs (such as the alteration of your outward/return flights by more than 12 hours, a change of resort or a reduction in the standard of your accommodation, you will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available or cancelling your travel
arrangements and receiving a full refund of all monies paid. In all cases, except where the change arises due to reasons of force majeure, we will pay compensation as detailed below:

Force Majeure: Compensation will not be payable if we are forced to cancel or change your travel arrangements in any way for reasons of war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other circumstances amounting to force majeure.
FINANCIAL PROTECTION
We are members of ABTA. Our licensed number is 42639/V1619. As such we are fully bonded according to ABTA’s rules and abide by ABTA’s Code of Conduct. In order to ensure that the monies you pay for your holiday are protected we will issue a confirmation invoice showing the details of the services you have booked including the price and the amount of money paid by you. You should check these details carefully and contact us immediately if there are any discrepancies. Please go to www.abta.com for a copy of the Guide to ABTA’s Scheme of Financial Protection.
The air holidays and flights in this brochure are ATOL Protected, since we hold an Air Travel Organiser’s Licence granted by the Civil Aviation Authority. Our ATOL number is ATOL3210. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. CONDITIONS OF CARRIAGE
Any transport arranged through us as part of a package is arranged by us as your agent, and your contract for the transport itself is directly between yourself and the carrier, and is subject to their terms and conditions. These will be detailed on your travel documents and copies can be supplied upon request.
All our holidays are covered by our ABTA bond for sail-drive holidays and by our CAA bond for fly-drive packages. All ferry services are supplied by schedule operators.
UNREASONABLE BEHAVIOUR
Should our suppliers deem you unfit to travel or a danger to others, you may be asked to leave. In such instances your contract will be terminated and you will be entirely responsible for all expenses.
ARBITRATION
Disputes arising out of, or in connection with, this contract which cannot be amicably settled may be referred to arbitration, if the customer so wishes, under a special Scheme arranged by the Association of British Travel Agents, and administered independently by the Chartered Institute of Arbitrators.
The Scheme provides for a simple and inexpensive method of arbitration on documents alone with restricted liability on the customer in respect of costs.
Full details will be provided on request or can be obtained from the ABTA website (www.abta.com). The Scheme does not apply to claims for an amount greater than £5,000 per person. There is also a limit of £25,000 per booking form. Neither does it apply to claims that are solely in respect of physical injury or illness or their consequences. The Scheme can however deal with compensation claims which include an element of minor injury or illness subject to a limit of £1,000 on the amount the arbitrator can award per person in respect of this element. The application for arbitration and Statement of Claim must be received by the Chartered Institute of Arbitrators within nine months of the date of return from the holiday. Outside this time limit arbitration under the Scheme may still be available if the company agrees, but the ABTA Code does not require such agreement.

In the past we have not passed on such fees, however our suppliers are now charging us and we must pass such charges on to you. Please try to stick to your original plans. Any changes will incur charges beyond our control. We do not profit from such changes, but by the same token we cannot be expected to make a loss.
